Welcome to Swing Society! These Terms of Service (“Terms”) outline the terms and conditions for renting and using our mobile golf simulator services. By booking or using our services, you agree to be bound by these Terms.
1. Service Overview
Swing Society provides mobile golf simulator rentals, including equipment setup, support, and related services (“Services”) for events such as corporate gatherings, private parties, fundraisers, and more. Our Services are available for rent within Northern and Central New Jersey.
2. Booking and Payment
2.1 Booking Confirmation
To secure a booking, a completed booking form and 50% deposit are required. This deposit will be applied to total event rental. Bookings are confirmed upon receipt of payment and a signed rental agreement.
2.2 Payment Terms
To confirm a reservation, a deposit of 50% of the total rental fee is required. For bookings made within 7 days of the event, full payment is required upon confirmation. The remaining balance must be paid in full upon our team's arrival and before the simulator session or setup begins.
2.3 Cancellation Policy
Initial deposits are eligible for a refund strictly according to the following schedule:
• 7+ days before the event: Full deposit refund.
• 3–6 days before the event: 50% deposit refund.
• Within 72 hours, same-day cancellations, or no-shows: The deposit is strictly non-refundable.
2.4 Rescheduling
We understand plans can change. Bookings may be rescheduled once, based on availability. Requests made within 72 hours of the even may be subject to a rescheduling fee.
2.5 Weather & Equipment
If Swing Society must cancel to due to unsafe weather, equipment issues, clients may choose either:
• A full deposit refund, or
• Rescheduling to a future available date
Light rain, moderate wind, or cold weather do not automatically qualify for cancellation if the setup can still operate safely.
3. Customer Responsibilities
3.1 Space & Power Requirements
The customer is responsible for providing a flat, level, and suitable space for the simulator setup (approximately 15ft x 15ft with a minimum ceiling clearance of 10ft). The customer must provide dedicated access to a standard, grounded 120V/15-amp electrical outlet within 50 feet of the setup area. Swing Society is not responsible for simulator downtime caused by inadequate power, tripped breakers, or shared circuits.
3.2 Safety and Supervision
The customer is responsible for ensuring a safe environment for guests using the simulator. Children under the age of 13 must be supervised while using the equipment.
3.3 Loss or Damage
Any damage to equipment caused by customer negligence or misuse may result in additional charges for repair or replacement. The customer agrees to take reasonable care of all equipment provided by Swing Society.
3.4 Clean Equipment Rule
Guests must use clean, mud-free shoes and the clean, unmarked golf balls provided exclusively by Swing Society. Dirty equipment or outside golf balls can permanently stain or damage the impact screen.
3.5 Right to Deny Service
Swing Society staff reserves the right to immediately suspend simulator access to any guest displaying unsafe swinging behavior, intoxication, or actions likely to damage the equipment.
4. Swing Society’s Responsibilities
4.1 Setup and Takedown
Our team will handle all aspects of simulator setup before the event and takedown afterward. We aim to complete setup within 45 minutes and takedown within 30 minutes, ensuring minimal disruption to the event.
4.2 On-Site Support
During the event, our staff will be available to provide assistance and technical support. We aim to ensure a smooth and enjoyable experience for all guests.
4.3 Equipment Maintenance
Swing Society will maintain the simulator and other equipment in good working order. Should any technical issues arise, we will make reasonable efforts to resolve them promptly.
5. Limitation of Liability & Release
To the fullest extent permitted by law, Swing Society, its owners, and employees shall not be liable for any personal injuries, property damage, or losses sustained by the customer or their guests arising from the use of our services or equipment. The customer explicitly assumes all risks inherent to the activity, including but not limited to being struck by golf balls, clubs, or ricochets. The customer agrees to indemnify and hold Swing Society harmless against any third-party injury claims arising during the rental period.
6. Intellectual Property
All content provided by Swing Society, including logos, images, text, and software (e.g., AwesomeGolf software), is protected by intellectual property laws and is for use solely in connection with our services. Any unauthorized use or reproduction of our content is prohibited.
7. Privacy
Swing Society respects the privacy of all customers. We collect and store personal information only for booking purposes and to improve our services. We do not share personal information with third parties unless required by law.
8. Media Release & Promotional Use
By booking our Services, the customer grants Swing Society a non-exclusive, royalty-free, perpetual license to take and use photographs, video recordings, or digital media of the event ("Media") for marketing, promotional, website, and social media purposes.
• Guest Notice: The customer is responsible for notifying their guests that a mobile golf simulator experience is being documented.
• Opt-Out Provision: If the customer prefers to keep their event private, they must notify Swing Society in writing via email (swingsocietynj@gmail.com) at least 48 hours prior to the event setup. Swing Society will strictly honor all opt-out requests.
9. Governing Law
These Terms of Service are governed by the laws of the State of New Jersey. Any disputes arising under or relating to these Terms will be resolved in the courts of New Jersey.
10. Changes to Terms of Service
Swing Society reserves the right to update or modify these Terms at any time. Any changes will be posted on our website, and continued use of our services following such updates signifies acceptance of the revised Terms.
